POLICIES AND PROCEDURES
  Condensed List of Client Rights

  1. The right to be informed of the Client’s Bill of Rights.
  2. The right to confidentiality of conversations and medical records, subject to the provisions of 52.30 of the State Mental Health Act which states: (a) Access without informed written consent. Notwithstanding par. (b) treatment records of an individual except as restricted without informed written consent in the following circumstances, except as restricted under par. (c) 1. to an individual, organization or management audits, financial audits or program monitoring and evaluation.
  3. The right to receive wages for work performed which involves the operation and maintenance of the facility except for matters of personal care (e.g. making one’s bed, etc.) or for therapeutic purposes.
  4. The right to petition a court according to law.
  5. The right to maintain the rights of a citizen (e.g. voting, marriage, obtaining a driver’s license, etc.)
  6. The right to receive prompt and adequate treatment.
  7. The right to receive medication and treatment on a voluntary basis prior to court hearings or commitment.
  8. The right to the least restrictive treatment conditions necessary.
  9. The right to have an informal hearing prior (except in emergencies) to being transferred to a more restrictive ward, unit or facility.
  10. The right to be free from unnecessary or excessive medication.
  11. The right to be free from physical restraint and involuntary isolation.
  12. The right not to receive psychosurgery, electro convulsive treatment, adversive conditioning, etc.
  13. The right to religious worship.
  14. The right not to participate in experimental research.
  15. The right to a humane psychological and physical environment.
  16. The right to send and receive sealed mail and to use a telephone.
  17. The right to select, use and wear own clothes, etc.
  18. The right to have individual storage space for private use.
  19. The right to privacy in dressing, toileting and bathing.
  20. The right to receive visitors.

No client rights will be denied unless the Director or designee of the facility has reason to believe that the exercise of the right would create a security problem, adversely affect the clients’ treatment or seriously interfere with the rights or safety of others. When a client’s right is to be denied, it will be according to the established procedure and conditions of Wisconsin Statute HSS94.05.
